The Kansas FAIR Plan (Kansas All-Industry Placement Facility) is a not-for-profit association formed by Kansas insurers to sell basic property insurance to people who can't get it from regular companies. The Kansas Department of Insurance says your property must be turned down by at least three companies first, and you apply through a licensed agent. What the Kansas FAIR Plan is
FAIR stands for "Fair Access to Insurance Requirements." The plan describes itself as "a not-for-profit insurance association formed by Kansas insurers to provide basic property and casualty insurance for responsible applicants, who have been unable to obtain insurance through the voluntary markets." Its legal name is the Kansas All-Industry Placement Facility, and its office is in Topeka.
Since July 1, 2017, the plan has operated under the Kansas FAIR plan act (K.S.A. 40-2142). The act says its purpose is "to make available basic property and casualty insurance to persons having property interests in this state who are in good faith entitled to, but who are unable to, procure such coverage through the voluntary market." Risks are shared among "member insurers who have voluntarily elected to participate." The Kansas Department of Insurance says the plan "is funded by participation of the admitted insurance companies who have the authority to write property insurance in Kansas."
We are not the Kansas FAIR Plan and are not affiliated with it. We explain the published rules; the plan and your agent make the decisions. [1][2][3]
Who is eligible
The Kansas Department of Insurance (KDOI) lists these qualifications:
- "Coverage for your property must be declined by at least three insurance companies before applying to the Kansas FAIR Plan." - "The FAIR Plan will inspect your property to determine whether you are eligible." - "Approval for coverage in the plan is not guaranteed." KDOI's website adds: "You do not have a guaranteed right to buy FAIR Plan coverage."
The plan's own site does not publish its underwriting rules (for example, rules on roof condition, vacancy or loss history). Ask your agent what the plan requires for your property. [1][2][4]
What it covers and what it doesn't
According to KDOI, the Kansas FAIR Plan "provides a property coverage policy and may offer optional theft and personal liability coverage." KDOI adds that the coverage "is not as comprehensive as homeowners insurance."
Kansas law requires every FAIR Plan policy to be issued "on the forms and in accordance with the reasonable rates and rating procedures approved by the commissioner of insurance," for a one-year term.
The plan's public website does not list its policy forms, coverage limits or deductibles. Your agent can get a quote and the policy forms through the plan's online system. Flood is not covered by homeowners or property policies in Kansas; see our sister site FloodHawk. [1][2][3]
How to apply
1. Shop the regular market first. KDOI says your property must be declined by at least three insurance companies. 2. Use an agent. "You can apply for the Kansas FAIR Plan through any licensed insurance agent who sells property insurance." 3. Your agent submits the application online. The plan says agents use its online policy writing system at my.ksfairplan.com "to get quotes, submit new applications and endorsements to existing policies, make payments, and print documents." 4. Inspection. The plan inspects the property to decide whether you are eligible. [1][2]

Rates and recent changes
Under the FAIR plan act, the Insurance Commissioner must approve or disapprove the plan's proposed rates within 60 days of filing (extendable by 30 days), and no policy may use proposed rates until they are approved.
The 2017 act replaced the plan's earlier authority under K.S.A. 40-2101, an older law that let insurers agree to share applicants who could not get insurance "through ordinary methods." The plan does not publish policy counts or rate changes on its website. [1][3][5]
Getting back to a regular insurer
The plan says it serves people "who have been unable to obtain insurance through the voluntary markets." Each FAIR Plan policy is written for one year. KDOI says premium factors "can vary widely from one company to the next" and that "You are encouraged to obtain quotes form [from] multiple insurance companies." [1][2][3]
